Welcome to VitaLiber. These Terms of Use ("Terms") govern your use of the VitaLiber mobile application ("App") developed and operated by NyoarGames ("we", "us", or "our"). The App is available on Android (Google Play Store) and iOS (Apple App Store).
By downloading, installing, or using VitaLiber, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Description of Service
VitaLiber is a personal book tracking application that allows you to:
- Search for and add books to your library
- Organize books into custom bookshelves and reading lists
- Track reading progress, dates, and page counts
- Rate and review books with detailed rating categories
- View reading statistics and insights
- Scan book barcodes and extract text using your device camera
- Import and export your book data via CSV files
2. Account Registration
- You must create an account using a valid email address or Google Sign-In to use the App.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must be at least 13 years old (or the minimum age required in your jurisdiction) to create an account.
- You agree to provide accurate information and to keep your account details up to date.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. User Content
You retain ownership of all content you create within the App, including reviews, ratings, and custom bookshelf names. By using the App, you grant us a limited license to store and process this content solely for the purpose of providing the service to you.
Your data stays on your device. Book data, reviews, and ratings are stored locally in a database on your device. We do not upload or store your book data on our servers.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws
- Attempt to reverse-engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's functionality or servers
- Attempt to gain unauthorized access to any part of the App or its systems
- Use automated systems (bots, scrapers) to access the App
- Circumvent any access restrictions, token systems, or usage limits
- Use the App to infringe on the intellectual property rights of others
5. In-App Tokens
Token System
VitaLiber uses an in-app token system to manage access to certain features. Tokens can be earned through app usage and activities.
- Tokens have no monetary value and cannot be exchanged for cash or transferred between accounts.
- We reserve the right to modify token costs, earning rates, and the features that require tokens at any time.
- Tokens may be forfeited if your account is terminated for violations of these Terms.
6. Subscriptions and Purchases
Premium Subscription
VitaLiber may offer premium subscription plans that provide access to additional features and remove certain limitations.
- Subscriptions are processed through the Apple App Store or Google Play Store, subject to their respective terms and conditions.
- Subscription prices are displayed in the App before purchase. Prices may vary by region.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscription through your device's app store settings.
- Refunds are handled by Apple or Google according to their refund policies.
7. Advertisements
The free version of VitaLiber displays advertisements served by Google AdMob. By using the free version, you consent to the display of ads. Subscribers to premium plans may experience an ad-free experience as described in the subscription details.
8. Third-Party Services
The App integrates with third-party services to provide its features:
We are not responsible for the availability, accuracy, or content provided by these third-party services.
9. Intellectual Property
- The App, including its design, code, graphics, and branding, is the property of NyoarGames and is protected by intellectual property laws.
- Book metadata (titles, cover images, descriptions) displayed in the App is sourced from the Google Books API and belongs to its respective copyright holders.
- You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
10. Data and Backups
Important: Since your book data is stored locally on your device, uninstalling the App or losing your device may result in data loss. We strongly recommend using the CSV export feature to back up your data regularly. We are not responsible for any data loss.
11. Disclaimers
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Uninterrupted or error-free operation
- Accuracy or completeness of book metadata from third-party sources
- Availability of third-party services (Google Books API, Firebase, etc.)
12. Limitation of Liability
To the maximum extent permitted by applicable law, NyoarGames shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data (including book collections, reviews, and reading history)
- Loss of profits or revenue
- Service interruptions
- Any damages arising from your use of or inability to use the App
13. Account Termination
- You may delete your account at any time through the App's settings.
- We may suspend or terminate your account if you violate these Terms.
- Upon account deletion, your Firebase authentication data will be permanently removed. Local data remains on your device until you uninstall the App.
14. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If we make material changes, we will endeavor to notify you through the App or other means.
15. Platform-Specific Terms
Apple App Store
- These Terms are between you and NyoarGames, not Apple Inc.
- Apple has no obligation to provide maintenance or support for the App.
- Apple is not responsible for any claims relating to the App (including product liability, legal compliance, or intellectual property).
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
16. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
